Understanding Your North Carolina Divorce Case

Do I Need a Lawyer to Get Divorced in North Carolina?

If you and your spouse both agree that your marriage is broken beyond repair and you don’t have any children or property together, you may not need to hire an attorney for your divorce. However, it’s important to keep in mind that you need to meet three conditions to obtain an absolute divorce in Mecklenburg County:

  1. You and your spouse must have lived separate and apart for one year.
  2. At least one of you must have intended to no longer participate in the marriage for the entire one-year period. (In other words, if you get back together and break up again, the one-year “separation clock” starts over.)
  3. At least one of you must have resided in North Carolina for six months before filing for divorce.
